Welcome to SunsetWx, LLC, an entity using in-depth algorithms to forecast sunrise and sunset quality around the globe (the “Service(s)”). Please read the following terms and conditions, thoroughly before using our website, online services and our mobile applications operated by SunsetWx, LLC.
By accessing or utilizing the Services, you hereby agree to be legally bound by the following terms and conditions (the “Terms of Service”). If you disagree, disrespect, or fail to comply with any part of the Terms of Service, SunsetWx, LLC has the right to terminate your access to the Service(s).
INTELLECTUAL PROPERTY
Use of the Service does not grant you access or permission to utilize the intellectual property of the algorithms contained in the Service. SunsetWx, LLC has the right to respond to notices of alleged copyright infringement and terminate accounts for infringers according to the process set out in the U.S. Digital Millennium Copyright Act which is incorporated within the Terms of Service by reference.
Using SunsetWx, LLC’s website, online services or mobile applications does not give you ownership of any intellectual property rights or the content you access of SunsetWx, LLC. Reproduction of SunsetWx, LLC’s plots, prediction data and/or graphics is prohibited without prior written consent. Data obtained from the Services must be accompanied by a legible SunsetWx logomark and type treatment, without any disfiguring alterations of any design element, along with a link back to the website, www.sunsetwx.com.
SOFTWARE
Some of the Services include downloadable software or images, which may update or refresh automatically on your electronic device once a new version or feature becomes available.
DISCLAIMERS
SunsetWx, LLC attempts to ensure timely, accurate predictions from the Service(s). Due to the predictive and dependent nature of the Service(s), SunsetWx, LLC cannot and will not represent to you that the Services will be 100% accurate or available.
The user assumes the entire risk related to the use of the Services provided by SunsetWx, LLC. SunsetWx, LLC provides information “as is” and disclaims any and all warranties, whether express or implied, including (without limitation) any implied warranties of merchantability or fitness for a particular purpose. In no event will SunsetWx, LLC be liable to you or to any direct third party for any direct, indirect, incidental, consequential, special or exemplary damages or lost profit from any use or misuse of the Services or data.
USER CONTENT
Given the interactive nature of our Services, you may be presented with the opportunity to upload, submit, or send SunsetWx, LLC content. You retain ownership of any personal content, including after a submission to SunsetWx, LLC, or any interaction with SunsetWx, LLC across all platforms. SunsetWx, LLC will not reproduce or use content shared with it without consent of the user.
TERMINATION/MODIFICATION
SunsetWx, LLC continuously updates and improves the Services that it offers. SunsetWx, LLC may add, tweak, expand upon, or remove a Service or function partially or completely at any time and without prior notice to users. Should any part of the Terms of Service change, the user’s continued use of the Services after any such changes constitutes full acceptance of the new terms.
SunsetWx, LLC may periodically audit your use of a Service to determine whether your usage of the Service is for-profit or not for-profit purposes. For-profit use of a Service without an active and non-delinquent subscription plan that is specifically marked as “Commercial” is strictly prohibited. SunsetWx, LLC may revoke access to Services without providing a refund for any for-profit use of a Service that is without an active and non-delinquent subscription plan that is specifically marked as “Commercial.”
SunsetWx, LLC may revoke access to Services without providing a refund for any misuse of a Service that could affect the reliability or integrity of a Service.
SunsetWx, LLC may revoke access to Services without providing a refund for any use of Service data by a 3rd party that is not properly attributed, as noted in the “Intellectual Property” section of these Terms of Service.
SunsetWx, LLC may revoke access to Services when there is reasonable suspicion of any fraudulent activity including but not limited to the use of fraudulent payment sources.
You have the right to stop using SunsetWx, LLC’s features at any time, unless otherwise bounded by a contract with SunsetWx, LLC.
